Consumer Health Data Privacy Policy

1. What this covers
This page explains how Shuark Inc. ("we") handles consumer health data in Orsola's Nutrition agent. It adds to our Privacy Policy and applies whether or not you live somewhere with a consumer health data law.
2. The health data we collect
- Meals you log, and the photos you take of food and packaging
- Your nutrition chat, including transcripts of what you say and voice recordings if you turn recording on
- Your year of birth (we check your full date once, to confirm you are 18 or over, and do not keep it)
- Height, weight, activity level and the sex used to estimate needs, if you choose personalised targets or a weight goal
- Weigh-ins, water, allergies, diet rules, goals and targets
- Products you scan, and files you choose to bring into your nutrition chat
3. Where it comes from
From you: what you type, say, photograph or scan, and files you add. Product details come from public food databases — USDA FoodData Central, the Canadian Nutrient File and Open Food Facts — which we query with a barcode or a food name, never with anything about you.
4. How we use it
Only to run the Nutrition agent for you: estimating what you ate, checking products against your allergies and diet, calculating targets, reminders you turn on, and showing your progress. We do not use it for advertising and we do not sell it. Nutrition screens load no analytics, and nutrition conversations are excluded from our diagnostic traces.
5. Who receives it
- Microsoft, which hosts Orsola and runs the Azure OpenAI service that reads your photos and messages for us. It is processed outside Canada, including in the United States. Microsoft does not use it to train its models and may keep it for up to 30 days to detect abuse and run the service.
- People or accounts you choose, only when you ask and after you agree to sharing: an email you approve (for example to your dietitian), or a file saved to your own Google Drive or OneDrive.
- Nobody else. We do not share it with advertisers or data brokers.
6. How long we keep it
- Your log and profile: until you delete them or withdraw your nutrition consent.
- Meal photos: 30 days after the meal is confirmed. Label photos: as long as the custom food they describe.
- Your nutrition chat, its files and recordings: until you delete them or withdraw.
- A record that something was shared and when — never what it said.
7. Your rights
You can see and export your nutrition data, delete it, and withdraw your consent at any time from the Nutrition settings tab — withdrawing deletes it. You can also ask us to confirm whether we have shared or sold it (we do not sell it) by writing to privacy@shuark.com. Depending on where you live — for example Washington, Nevada, Connecticut or New York in the United States, or Quebec in Canada — these are rights the law gives you, and we extend them to everyone.
